Welcome to D&D Photos. These Terms of Service ("Terms") govern your use of our website and photography services. By accessing our website or using our services, you agree to be bound by these Terms.

1. Services

D&D Photos provides professional wedding photography services in Lexington, Kentucky and surrounding areas. Our services include:

  • Wedding day photography
  • Engagement sessions
  • Photo editing and retouching
  • Digital image delivery
  • Print services (if applicable)

2. Booking and Payment

2.1 Booking Process

To book our services, you must:

  • Contact us through our website or phone
  • Provide accurate information about your event
  • Sign a photography agreement
  • Pay the required deposit to secure your date

2.2 Payment Terms

  • A non-refundable deposit is required to secure your booking
  • Remaining balance is due before or on the day of your event
  • Payment methods accepted: cash, check, or electronic payment
  • Late payments may result in additional fees

3. Cancellation and Rescheduling

3.1 Cancellation Policy

  • Cancellations made more than 30 days before the event: deposit may be applied to a future date
  • Cancellations made 14-30 days before the event: 50% of total fee is due
  • Cancellations made less than 14 days before the event: full payment is due

3.2 Rescheduling

We understand that circumstances may require rescheduling. We will work with you to find an alternative date, subject to our availability. Additional fees may apply for rescheduling.

4. Photography Services

4.1 Coverage

Our photography coverage includes:

  • Pre-wedding consultation and planning
  • Wedding day photography as specified in your package
  • Professional editing and retouching
  • Digital image delivery within the specified timeframe

4.2 Image Delivery

  • Engagement photos: delivered within 2 weeks
  • Wedding photos: delivered within 6-8 weeks
  • Images are delivered via online gallery
  • High-resolution images are included in your package

5. Client Responsibilities

As our client, you agree to:

  • Provide accurate information about your event
  • Communicate any special requests or requirements in advance
  • Ensure all necessary permits and permissions are obtained
  • Provide a timeline for your wedding day
  • Designate a point of contact for the photographer on your wedding day

6. Copyright and Usage Rights

6.1 Copyright

D&D Photos retains copyright to all images created during your session. However, you receive a license to use the images for personal purposes.

6.2 Usage Rights

You may:

  • Print images for personal use
  • Share images on social media
  • Use images for personal announcements and cards

You may not:

  • Sell or profit from the images
  • Edit or alter the images without permission
  • Use images for commercial purposes

7. Limitation of Liability

D&D Photos is not liable for:

  • Acts of God or weather conditions
  • Equipment failure beyond our control
  • Client or guest behavior that affects photography
  • Loss or damage of personal property

Our total liability is limited to the amount paid for our services.

8. Indemnification

You agree to indemnify and hold harmless D&D Photos from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

9. Privacy

We respect your privacy and will handle your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky. Any disputes will be resolved in the courts of Fayette County, Kentucky.
